1. Basic terms
Personal data is any information about a natural person (data subject) on the basis of which the natural person can be identified.
The data subject is a living natural person whose personal data is processed. The data subject within the meaning of the GDPR is not a legal person and the GDPR therefore does not apply to data processed about a legal person, because data relating to a legal person is not personal data. The GDPR does not apply to data about deceased persons.
Controller and processor
Both the controller and the processor are legal or natural persons who handle personal data.
The controller (in this case Helppes o.p.s.) is the party for whose “benefit” the personal data are processed. Therefore, the controller is always primarily responsible for their processing. The controller decides on the purpose, manner, scope and means by which the personal data will be processed.
The processor (in this case Helppes o.p.s. and entities that Helppes o.p.s. entrusts with the processing) is, on the other hand, the person who carries out the processing of personal data on the basis of instructions (authorization) and for the benefit of the controller. A contractual relationship is established between the controller and the processor. The primary controller in relation to the data subject is always the controller, not the processor, however, in some cases the subject may contact the processor directly.
2. In general
Helppes o.p.s. processes and stores personal data in accordance with applicable legal regulations – i.e. with Act No. 101/2000 Coll. and, with effect from May 25, 2018, also in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
3. What personal data do we process?
The personal data we process include:
• Name
• Address
• Email address (if provided)
• Phone number (if provided)
• Date of birth (if provided)
• Tax ID and VAT number (if provided)
• Bank account number (if provided)
• Method of obtaining your data
• Providing your personal data is voluntary. However, due to other regulations, we must retain your personal data in some cases. For example, if you provide us with a financial donation, we are obliged to retain this fact for ten years in our accounting records.
4. How is your personal data handled?
Helppes o.p.s. uses your personal data for the following purposes:
• To process donations
• To communicate with donors
• To inform about our projects and their results
• To process your requests or inquiries
• To obtain feedback
• To modify your personal data and exercise your rights in accordance with the standards governing the protection of personal data. For example, to allow you access to your personal data.
• To comply with applicable legal obligations
5. Who has access to your personal data?
We share your personal data with a few third parties. These third parties are:
• service providers who need access to your personal data to provide services (including providers who process personal data on our behalf for the purposes of informing donors, storing and editing data, providing IT and marketing services and data analytics)
• public authorities
• professional advisors (accountants, auditors, lawyers and other business contacts)
These third parties may be located in the Czech Republic, in other countries within the European Economic Area (EEA). The wording of the applicable personal data protection laws in these countries may differ. We only enter into contractual relationships with third parties that we believe maintain an adequate level of data protection to protect any personal data held in that country and that these third parties will always act in accordance with applicable data protection laws.
6. Your rights in relation to your personal data
You have the right to ask us for a copy of the personal data we hold about you and to obtain a description of the purposes for which it has been used. If you find that the data we hold about you is inaccurate or that the purpose for which it was collected is no longer necessary, please contact us. The contacts are listed below.
You also have the following rights:
• Right to restriction of processing – if you want to temporarily stop supporting us, you contest the accuracy of the data (until we make a correction) or if you object to the processing of your data (until we examine your complaint).
• Right to erasure or deletion – you also have the right to request us to erase or delete your personal data from the database (including consent to direct marketing, however, this does not apply in cases where we have another legal justification to continue processing your data or its processing is in our legitimate interest).
• The right to object to processing on grounds of legitimate interest – to the extent that the processing of your personal data is necessary.

If you want to file a complaint about the way your personal data has been handled, please contact us and your complaint will be investigated. You also have the right to file a complaint with a supervisory authority (i.e. the Office for Personal Data Protection of the Czech Republic, Pplk. Sochora 27, 170 00 Prague 7).
8. Changes to the statement
Helppes o.p.s. reserves the right to amend this statement in light of developments in the implementation and interpretation of the General Data Protection Regulation (GDPR).
